The Logic of Contempt
In the context of family law, most contempt of court actions fall under the sphere of constructive civil contempt. Constructive, as opposed to direct, contempt is contempt that occurs outside of 'the presence of the judge presiding in court or so near to the judge as to interrupt the court's proceedings. Therefore, a constructive civil contempt order uses a penalty that the person in contempt can escape by doing a specific action that they are capable of doing. In 2008, the Supreme Court of Maryland held that "the purpose of civil contempt is to coerce present or future compliance with a court order, whereas imposing a sanction for past misconduct is the function of criminal contempt. Note: When the Court made this ruling in 2008, it was known as the Court of Appeals not the Supreme Court of Maryland.
