As a general principle, a parent cannot be forced to pay for private school if he or she never validated the decision to enroll the minor child in private school. If the parties agreed in the past to a private school and the minor child has already been enrolled in a private school, that is a different story and both parties can be required to honor their agreement to send the minor child to private school and not disrupt his or her education.However, the Court may not order contribution to private school tuition and transportation costs unless the court finds that parent has the ability to pay based on actual income and expenses. Given the increasing cost of private school, it is important that any agreement concerning private school states that the party shall cooperate to complete all financial aid forms in a prompt manner. In certain instances, parties may agree to divide the costs of college tuition as part of divorce and custody settlement agreements.
